• Stripe: Payment processing (Stripe Privacy Policy)
• AI Processing: Third-party AI services for content animation features, bound by strict data protection agreements

6. Feature-Specific Data Processing & AI

Certain advanced features of our Service require specialized data processing that may involve different privacy considerations. By choosing to use these features, you acknowledge the following:

A. AI & Talking Photos

To provide "Talking Photos" and "Talking Documents," we use third-party Artificial Intelligence (AI) services to analyze your uploaded images and audio. We only send the specific content you select for animation, and our agreements with these providers prohibit them from using your content for any other purpose, including training their models. We do not use your personal family photos, videos, or audio to train our own or any third-party AI models without your explicit, opt-in consent.

B. Public Sharing & Microsites

If you use our "Microsite" or "Share Link" features, you are choosing to make specific content accessible to anyone who has the link. Content shared via these methods is not encrypted via our standard Vault protections during access, as the purpose is public or semi-public viewing. You are solely responsible for the content you choose to share publicly.

7. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to:

• Essential Cookies: Enable core functionality (login, security, preferences)
• Analytics Cookies: Understand how users interact with our Service
• Preference Cookies: Remember your settings and preferences

When you first visit our website from certain regions, you may be prompted to provide consent for the use of non-essential cookies. You can also control cookies through your browser settings. Disabling certain cookies may limit your ability to use some features of our Service.

9. Children's Privacy

Our Service is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately.

Individuals between 13 and 18 may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by our Terms of Service on the minor's behalf.

10. Content Moderation and Violation Data

When content is flagged, reported, or detected as violating our Prohibited Content policies, we collect and retain the following information in connection with enforcement actions:

• A record of the violation, including the type and date of the offense
• The content in question (or a hash/fingerprint thereof) for evidence and audit purposes
• Your IP address, device information, and access logs at the time of upload
• Any communications related to the violation, including appeals

Violation records are retained indefinitely and are not subject to deletion requests. This data may be shared with law enforcement agencies in accordance with Section 5 of this Privacy Policy. For violations involving child sexual abuse material (CSAM), all relevant data is reported to NCMEC and preserved in accordance with federal law (18 U.S.C. § 2258A).

Content removed for policy violations may be retained by VideoAncestry solely for the purposes of evidence preservation, legal compliance, and preventing re-upload.

11. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to:

• Comply with our legal obligations
• Resolve disputes
• Enforce our agreements
• Fulfill our long-term storage commitments as described in our Terms of Service

Upon account termination or lapse into Inactive Status, we will retain your data for a minimum of ninety (90) days. During this period, you may reactivate your account or request a final export of your content. After the grace period, all content associated with your account may be permanently deleted unless retention is required by law.

11b. Free Trial Content

When your free trial ends, your creations (talking photos, journal entries, and uploaded files) remain shareable — share links continue to work indefinitely. However, you will no longer be able to edit, modify, or create new content without upgrading to a paid membership.

Content you created during your trial is no longer attached to your account after expiration. You may return at any time to delete your content permanently. If you do not delete it, VideoAncestry retains the right to keep it available via its existing share links.

To request deletion of trial content, contact us at [email protected].

12. International Data Transfers

Our services are hosted in the United States. If you access the Service from other regions, please be aware that your information will be transferred to, stored, and processed in the United States.

For transfers of personal data from the European Economic Area (EEA), United Kingdom, and Switzerland, we rely on appropriate legal mechanisms, including the European Commission's approved Standard Contractual Clauses (SCCs), to ensure your data receives a level of protection equivalent to that provided by European law.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date.

For significant changes, we will provide additional notice, such as an email notification. Your continued use of the Service after any changes indicates your acceptance of the updated Privacy Policy. We maintain an archive of prior versions of this Privacy Policy for your review.
